Acquitted exalcaldesa (e) of Monterrey (Casanare)

The Attorney General's Office overturned the lower court ruling handed down on November 16, 2011, which was passed to Mrs. Barajas Rubiela Leguizamo in his capacity as mayor (e) of the municipality of Monterrey (Casanare) and instead acquitted of the charges.

Mrs. Barajas Leguizamo had been sanctioned by dismissal and general disqualification for a period of ten years, considering that it had violated the rules of ineligibility and incompatibility for the post of mayor of Monterrey, Casanare, because a year earlier had served as inspector of Police and Commissioner of Family in the same municipality.

Mrs. Barajas Leguizamo was in charge of municipal administration through Decree 0135 of 17 July 2007 and took office on 23 July of that year.

In resolving the appeal, the Second Deputy Attorney General for Administrative Supervision concluded that the rule was applied to the sanction, paragraph 2 of Article 37 of Law 617 of 2000 was expressly repealed by subsection 2 of paragraph 3 of Article 29 of Act 1475 which came into effect on July 15, 2011.

The prosecution explained that necessary in this case the revocation of the sanction imposed in the judgment of first instance, to be fully demonstrated that, by the time of imposing the sanction, the law creating the inability to disciplined foisted had been repealed, thus the inability for which he was questioned Mrs. Barajas Leguizamo Rubiela no longer prevailed in the legal system.
