The Attorney General's Office filed an appeal requesting the annulment of the court ruling handed down by the judge 40 Criminal Circuit, which condemns Mr. Hector Julio Gomez Gonzalez to 60 months in prison and a fine of $ 68 million pesos, behaviors that had been signed a preliminary agreement with the Attorney General's Office, in the process known as "carousel" of engagement.

The prosecution objected to the draft agreement to consider that there may be pre agreed charges, which had not returned all the money from the capital increase and had not been charged a number of criminal conduct.

A Julio Gomez attributed the embezzlement through appropriation as an intervener, conspiracy as an author and undue interest in the contracts as intervener, having signed with several officials handling IDU irregular Bogota hiring, making it a series of contracts awarded to the road network and recovery, plus the alleged manipulation of the tender documents and evaluation of contracts.

Similarly, the gentlemen got Nule allegedly paid him a sum of money on the performance so as not to declare the bid void which finally ended with the signing of Contract No. 137 for the construction of Phase III of TransMilenio.

The settlement reached was determined by three foundational reasons: the acceptance of all the charges from the moment they were allocated, the return of the advance, as reimbursement of any sum of money that was quantified as the value of embezzlement committed; and the explicit commitment to partnership with the administration of justice speaking as a witness.
