Attorney General's Office confirmed in a ruling on appeal dismissal and disability for 10 years against two councilors of San Vicente del Caguan (Caquetá)

The Attorney General's Office, in ruling on appeal, sanctioned by dismissal and inability to exercise in public office for 10 years to Mr. Barrios Placido Murcia Perdomo and Aurelio Sanchez, who acted as councilors of the municipality of San Vicente del Caguan ( Caquetá) for the material time for the payment of three (3) days of sessions from November 2010 to Mr. Murcia Sanchez, being punished by deprivation of liberty by the court.

The disciplinary ruling issued by the Attorney First Division for Administrative Supervision confirms in full the sanction decision handed down in July 2011 by the Regional Office of Caquetá, which based its decision that the council had continued to exercise Murcia as mayor, despite the criminal penalty failed on appeal against the Circuit Court Promiscuous Puerto Rico, Caquetá, in September 2010, being obliged to immediately notify the corporation of the existence of a cause of disability as described in article 6 of Act 190 of 1995.

For his part, Councilman Barrios Perdomo, who at the date of the act reprehensible held the presidency of the town council, is sanctioned by the controlling body for not acting in accordance with the provisions of Article 57 of Law 136 of 1994 in the sense that it must take steps to enforce the cessation of the functions from the date of the judgment enforceable, ie from October 2010.

Additionally, the Attorney General found that the then president of the municipal duma, knowing the statement to cause the disability, Murcia Sanchez allowed to attend sessions in November of that year and subsequently ordered the payment of fees.

The decision no appeal having been exhausted in this way the governmental discipline, as they were notified personally disciplined.
