Attorney General's Office confirmed on appeal penalty of 3 months for former governor of Chocó

The Attorney General's Office confirmed in a ruling on appeal the sanction of three months of suspension in the exercise of the office for Julio Mosquera Ibargüen, as governor of the department of Chocó to the time of the events, for disregarding a order contained in a judgment handed down by the supervisory Single Room Superior Court Judicial District of Pretoria.

When discipline is criticized for failing to provide substantive response to a request made right by the citizen Miguel Angel Moreno Mena within the terms of Law or later, despite having been notified of the court ruling that recognized the right established the plaintiff, having been notified of the opening of the contempt proceeding, and finally, it was also notified of the ruling by which the penalty is imposed for failing correctional court order given.

Disciplined behavior is attributed to an offense under Article 34 of Law 734 of 2002, specifically in regard to the duty imposed on public servants to comply with and enforce judicial decisions.

The ruling states that confirmatory looked at the degree of culpability, the nature of public service commitment, the degree of disturbance of the same social and behavioral significance, and is recognized this by the Disciplinary Code and lack of diligence and efficiency of the sanctioned indicating that the act committed is serious strain.

Under the same Act 734 of 2002 in the event that has stopped the disciplined exercise of their official duties for the time of execution of the Order, the settlement will take place at the time wages earned for the period of the sanction.
