Attorney General's Office confirmed sanction to presidents of the Municipal Council of Villavicencio (Meta)

By breaching the obligation to provide a complete and timely provision of clothing and footwear to officials of the City Council of Villavicencio, the Attorney General's Office confirmed the sanction of suspension in the exercise of the office for a term of one month to Mr. Parra and Jose Gongora Orbey Heli Baquero Mateus, in his capacity as president of the corporation for the years 2006 and 2007

In resolving the appeal, the Second Deputy Attorney General for Administrative Supervision found that the presidents of the Council of Villavicencio breached Law 70 of 1988 and Regulatory Decree 1978 of 1989, which state that public sector employees whose pay is less than twice the legal minimum wage and having served more than three months in service, are entitled, every four months, providing a supply of shoes and clothing for work, which must take place on April 30, 30 August December 30 of each year.

For the prosecution's conduct incurred the disciplined infringed the rights of workers and generated an elementary neglect of the duties with gross violation of mandatory rules.

During the trial proved that the supply of envelopes to be delivered on 30 April and 30 August 2007, only made on 21 November of that year, proving definitively that it was so late.

The penalty was converted into wages in accordance with the fees earned by the time of the commission of the offense, disciplinary finding them responsible for serious misconduct by way of a very serious offense

The attorney recalled that settled jurisprudence, the Supreme Court noted that the social benefit was created to benefit lower-income workers, to enable the use of work clothing and footwear appropriate for labor, reducing the expenses they incur to purchase such items.
