Attorney General's Office contested guardianship ruling vacated, the decision to revoke the detention order of excomisionado Peace

The Attorney General's Office appealed to the Supreme Court handed down the judgment of guardianship by the Superior Tribunal of Bogota, in which it vacated, the decision of the judge guarantees 45 of revoking the order for the arrest of the Peace excomisionado Luis Carlos Restrepo Ramírez, considering that the application for protection is not admissible against court orders but in exceptional circumstances not present in this case.

Likewise, the public prosecutor appealed the ruling because the Court supervised Providence did make a proper assessment of the elements on which stand the security measure.

For the Attorney, the decision to revoke the injunction against the Peace excomisionado was supported in the absence of evidence of reasonable inference of authorship in fact, appreciating the means of knowledge in a fair and objective weighting, jointly and isolated and individual as claimed by the Court in the judgment of guardianship

Finally, the representative of society relates all the inconsistencies of the decision and concluded that "none of the arguments over the competition are awarded the importance that the Court, but if discussion is allowed to grace the judge went beyond competence, had no effect (...) orders, invitations, reviews or recommendations on the decision made to revoke the detention order imposed intramural. "

The facts on which the process moves forward, refer to the demobilization of the front called "Cacica the Gaitana" of the FARC, which occurred in March 2007.
