By irregularities in the allocation of scarce goods delivered by the DIAN, the Attorney General's Office made the statement of objections to Mr. Edgar Velez Hernandez, in his capacity as mayor of Falan (Tolima) for the material time.

The goods among which include TVs, DVDs, stereos, among others, were delivered by the DIAN to the municipality through Resolution No. 06572 of June 4, 2007.

The prosecution seeks to establish whether the mayor committed a disciplinary offense to allow between July and November 2007, these goods were delivered without meeting the selection criteria and not meet the programs for which they were intended.

According to the evidence, it seems, such delivery was made knowing that these elements should serve social programs in health, education, public safety, prevention and relief, and under strict selection parameters, which was not fulfilled.

According to the complaints that led to the research, selection of beneficiaries is done through the chairmen of boards of Community Action and town councilors had been used without prioritization and selection tools, but by appealing to the subjective judgment of others.

Provincial Attorney for Honda for this situation the responsibility of the mayor, because although it could be left to subordinate the physical delivery of the items, there is no instrument of delegation that allows exemption from liability, so it was his duty to exercise control on the activity of their subordinates.
