Attorney General's Office submitted comments on the process and implementation of the General Code of Procedure

The Attorney General's Office, in a meeting this week with members of the committee of speakers of the bill by which it seeks to issue the General Code of Procedure, noted the advantages in terms of transparency and efficiency to offer, especially orality in the context of civil proceedings.

However, for the prosecution deserves special concern to be considered as sufficient period of adaptation of the new system, the implementation of Act 1395 of 2010, which houses a system of hearings process, since that statute has not entered into force in throughout the country and has not operated fully in those judicial districts where it has been launched.

Similarly, there is a study of costs and benefits based on updated and reliable statistics that allow gauge the economic resources and human talent needed to implement the new code, nor have sufficient budget appropriations made it possible to deepen and extend the formation of the more than 10,000 officials from the offices with expertise in these areas.

Also, the Office notes that there is not yet with the new permanent offices required to implement the Code, existing judicial courts do not have the appropriate technological tools and have not been built or appropriate all courtrooms that are needed.

For the controlling body for the implementation of orality in civil, commercial, family, agricultural and consumer law, necessary to continue and strengthen the process of training to judges, to establish a system for certifying the adequacy of counsel to institute legal proceedings in oral proceedings and court officers, and to reduce court congestion levels that currently exist in Colombia.

In this sense, the chief prosecutors summon the Ministries of Finance and Justice to an urgent meeting in order to find solutions to the budget issue for the implementation of the General Code of Procedure.

Attorney will meet on Wednesday 16 May with all speakers of the bill

In order to enrich the debate on the structure of civil proceedings in the General Code of Procedure, the Public Ministry, through the Special Prosecutor in Civil Affairs and the special rapporteurs, will meet next on May 16 with the participation of Ministry of Justice and the Institute of Procedural Law.

In the analysis made by the Office of the difficulties in processing and implementation of the General Code of Procedure, also took oral magistrates and judges, procurators, scholars, litigators and legal advisers.
