Attorney General's Office suspended for 6 months a former mayor of Mistrató (Risaralda) for GSP allocate resources for other purposes than those specified in the Act

In ruling on appeal, the Attorney General's Office sanctioned by suspending his performance of duties for a period of 6 months, Mr. Javier de Jesús Valencia Espinosa, former mayor of Mistrató, Risaralda, for canceling a contract to provide services professionals were drawn exclusively monies for other purposes, by the General Participation System (SGP).

The ruling was handed down by the Regional Office Risaralda disciplined inobservó notes that Articles 16 and 23 of Act 715 of 2001, as Act 734 of 2002, because in his capacity as mayor ran 12 million 600 thousand pesos GSP resources through the professional services contract to coordinate and oversee the higher education studies, which are not intended for that purpose.

The control entity demonstrated the existence of a disciplinary offense to have canceled the contract with monies that were to be invested in the quality of education component, which corresponds mainly to school endowments, maintenance and improvement of infrastructure charges for departmental administration, supervision and information systems, according to Law 715 of 2001.

Given that Mr. Valencia Espinosa no longer serves as a local leader, the Attorney General clarified in the operative paragraphs of the judgment that an inability physical and material execution, the penalty shall become wages according to the accrual for the time commission of the offense, ie for the duration of 2009.

The disciplinary offense is graded as very serious by way of negligence, the wording of Article 48 of Act 734 of 2002.

Against this judgment, no appeal by administrative channels.
