Attorney utters charge sheet against 12 councilors Cartago (Valle)

The Attorney General's Office uttered charge sheet against 12 council members, for the time of the events, Cartago (Valle) for alleged irregularities in the approval of the municipal agreement by which authorized the mayor to commit resources to future years 2023.

The deputies are disciplined Diego Quintero Jose Herrera, Juan Carlos Arias Montoya, Jose Eliezer Perez Cardona Botero Arturo Palomo, Ramiro Jose Chaux Restrepo, Luis Fernando Gaviria Acevedo, Jaime Enrique Tamayo Zuluaga, Maria Cruz Riascos Jordan, Cesar Tulio Ospina Rivera, Nestor Jaime Castillo Alarcón, Wilson Galvis and Luis Moncada Ossa Arley González.

According to the order handed down by the Provincial Office of Cartago (Valle), inquirers may incur in misconduct constituting breach of discipline for breach of their duty, to vote for the approval of the Municipal Agreement No. 007 of April 2, 2009, through which the authorizations are granted to the mayor, without complying with legal requirements. The failure is classified as very serious and willful.

This act refers to exceptional future years, as the common future years, however correspond to two different categories of future years in its structure, requirements and sources. Similarly, authorized the president to run municipal government at its investment projects in water and sanitation, without specifying and quantifying the projects intended to run, so that failure to establish its value and the term of execution among others, could not reasonably establish whether they were or not in the Master Plan and Water and Sewer Master Plan for Sanitation.

The agreement also establishes municipal approved the amount of commitment that is authorized to assume, the term and conditions in future years, not consulted multiannual targets medium-term fiscal framework and whether the commitments sought to acquire, overflowing or not municipal borrowing capacity. Finally also required that the requested future years, would gain ownership of 15% in the fiscal 2009.
