Charge sheet against former governor of Bolivar by irregularities in contracts to serve those affected by the winter crisis

 

The Attorney General's Office file charges Mr. Libardo Simancas Torres, governor of Bolivar for the period 2004 to 2007, raid on a very serious offense possible, referring to the signing and execution of contracts to address the social crisis caused by the cold wave that hit the department in 2007.

The blanket statement of objections also to Mr. Walter Jiménez Vanegas, in his capacity as secretary of health department and Villareal Joaco Berrio, the governor of the department for the period 2008 to 2011, dismissed by the Ombudsman in 2009.

According to evidence gathered as part of manifest urgency enacted in June and December 2007, Simancas Torres exmandatario held seven contracts, more than 3,900 million pesos, which included the 6971 purchase of markets and hygiene kits, with two contractors who apparently had no infrastructure, experience or fitness to perform the contractual objects designed to ward off social crisis resulting from the cold wave affecting the department of Bolivar.

In this regard, the Office notes that the contracted entities did not have the administrative organization, nor had the expertise necessary for timely and adequate supply of inputs, components and drugs purchased, prompting is not met with timely delivery, timely and expeditious assistance to those affected by the winter, before the doctor Libardo Simancas left office as governor of Bolivar.

Also being investigated Mr. Walter Jimenez, who as secretary of Health department had certified that the firms hired were suitable to meet the contract "without their demonstrated expertise, infrastructure or any organization."

On the other hand, charges the Simancas Torres exmandatario incursion in misconduct (no grave) the improper use of emergency contracting, since, despite having declared manifest urgency in June 2007, the departmental administration took a month to acquire, through a body devoid of qualifications and without fulfilling the requirement of a written contract, medicines and other supplies antivenom in the amount of 556 million pesos to serve those affected by the winter crisis.

Finally, charges Mr. Villarreal Joaco Berrio, the governor of Bolivar, in a very serious offense possible incursion by participating in the execution of contracts to address the social crisis originated in the rainy season of 2007, violating the principles of economy and accountability, enforceable contractual activity for not having taken the necessary steps to ensure that such agreements are executed correctly and this will ensure the delivery of humanitarian aid and the effectiveness of the rights of the community concerned.
     
Additionally it was decided to dispatch a copy of the statement of objections to the Regional Office of Bolivar, so that filing separate investigation into Mr. Johan Toncel Ochoa, director of the Legal Administrative Department of Bolivar at the time, because, apparently, acted unlawfully against non-delivery of medicines and supplies to those affected by the rainy season of 2007 and no irregularities in the payment of several sales contracts.
