For violation of international humanitarian law, dismissed or disqualified for 20 years members of the Army

For causing the death of a protected person, the Attorney General's Office dismissed and disqualified for 20 years after Fabian Hernandez Rodriguez and third professional soldiers Edeyvis Miranda Beard and Juvenal Lopez Rodriguez, assigned to the year 2004 to the Second Platoon of Company vulture.

The incident occurred on July 1, 2004 on 6:30 am, when the victim was moved from where spent the night at the farm where she worked. Apparently, when the citizen was traveling met with some members of the Army who fired their weapons endowment and after his death was presented as a subversive killed in armed combat.

In development of the disciplinary process was established that while the victim was carrying a shotgun, this weapon was not used by citizens against members of the Army. Consequently, there was no attack on the military forced them to react to save their lives as they said.

Against this decision of first instance should the appeal to be decided by the Disciplinary Board.
