In ruling on appeal, former mayors and former secretary punished Health Arenal (Bolivar)

The Attorney General's Office passed on appeal suspended for 12 months and inability to hold public offices for the same period to Carlos Ramon Pacheco and Anibal Zayas Jalabe Pacheco, in his capacity as mayor of the town of Arenal (Bolivar), for allowing remain in office to a staff member without due requirements.

The disciplined Alfonso Peña Sierra was sworn in as Municipal Health Secretary in April 2001 and remained in office until July 2010. The disciplinary reproach arises because the decree 785 of 17 March 2005 establishes the requirement for municipalities in third to sixth category as the head of the health portfolio must hold a professional degree in the health area, did not satisfy the requirement that disciplined despite which he continued in office with the consent of the two local leaders punished.

The situation was an excess in the exercise of their functions, which was considered a serious offense, committed by way of fraud. For their part, were punished for allowing former mayors remaining in office without meeting the requirements to do so, knowing that there was no health professional.

For the three disciplined, if they are not exercising civil penalty shall be paid under the terms of Article 46 of the Single Disciplinary Code, making the penalty time accrued wages for the time.

As a decision on appeal, against the same no appeal.
