The Attorney General's Office, in ruling on appeal, upheld the penalty of two months against Mrs. Cely Luzmila Finch, teacher of the school Our Lady of O Otengá, located in the village Soiquia Betéitiva Township, Boyacá for having committed a violation of disciplinary rules that apply to servants of the State through the Act 734 of 2002.

The lack of discipline in which incurred the teacher asked him consisted of students of all grades of transition until fifth grade and in charge of serving lunch at the institution, to take off their clothes in the classroom with the cell to find the property that he had lost the day in question.

The ruling, issued by the Attorney First Division for Administrative Supervision, confirms the same way as with the act that is alleged had affected several constitutional provisions, and Act 1098 of 2006 and that under Article 34 of Law 734 of 2002, the fact is considered serious misconduct, with the degree of culpability of negligence.

Finally, the control entity Pinzón said that the teacher showed Cely breach of duty of care which he had incurred, having acted in a state of despair at not finding her cell phone and can use other mechanisms that are not harmful or that interfere in the rights of the children.
