Statement of charges against five members of the Army

The Attorney General's Office statement of objections made by Lieutenant Edward Lopez Forero, after the second Castañeda Jorge Eliezer Arias and Solano Delgado Willinton professional soldiers, Never Bee Benavides and Nelson Villamizar, belonging to the group DELTA Special Mobile Brigade nro.5 National Army, who apparently took part in grave violations of international humanitarian law.

The facts that the disciplinary investigation occurred in September 2007 in the village of Caño Guayabo, inspection of Pueblo Nuevo, in the municipality of Tame (Arauca), where the soldiers apparently raided a house, got from there to delegate the community action board and then shot him and killed him.

According to the information contained in the Survey Act, pursuant to the tactical mission 'Zagaz 3', "troops of BCG 44, DELTA special unit under the command of Lieutenant Forero, killed in combat FARC terrorist suspect."

However, according to the analysis of evidence collected in the opinion of the Attorney Disciplinary Representative for Human Rights is not credible version of the disciplined that there was an encounter battle because "how bout holding a meeting with someone who apparently did not fire the gun he had? "and so far there is no evidence that the victim had shot the soldiers with the shotgun he had taken as his constant companion, when he heard noises around the house.
 
Additionally, two of the shots inflicted on the victim occurred in the back, allowing inferences that may not respect the principles of proportionality, limitation, distinction and immunity of the civilian population.

Consequently, we investigate then the five members of the Army, who possibly ordered, participated and sponsored the killing of the Caño inhabitant of the village of Guava, inspection of Pueblo Nuevo, in the municipality of Tame (Arauca).
