The Attorney General's Office Mayor acquitted of Honda (Tolima)

The Attorney General's Office reversed the decision of first instance in which it was sanctioned by suspending his performance of duties for a period of six months Mr. Carlos Alberto Arce Camacho, in his capacity as mayor of Honda (Tolima) for the material time.

Mr. Arce Camacho had been sanctioned by suspending his tenure as six months for public hearing conducted by the Provincial Attorney Honda, finding it responsible for the irregularities in the Public Tender No. 04 of 2009, whose object was the construction of urban planning.

In turn, the decision at first instance, the Provincial Attorney Honda considered the disciplinary offense was set for failure to exercise sufficient control over the actions taken by their subordinates in the publication of the draft specification.
 
The Attorney General found that the publication was made on December 10, 2009, just seven days before the opening of the selection process, which was breached as enshrined in Article 9 of Decree 2474 of 2008, which indicates that the publication must be made no earlier than ten working days.
 
In resolving the appeal the Regional Office of Tolima confirmed that in his capacity as Mayor of Honda, Mr. Arce Camacho did conduct checks on hiring activity in the municipality and said that the record evidence that acts involving the exercise of supervisory power and control.
 
He concluded that in the absence of certain evidence on the responsibility of the mayor in connection with these events are cautioned doubt as to the breach of discipline, so decided to acquit him of the charges.
